By accessing or using PinotWalk ("Service"), operated by Pinot Walk, Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

PinotWalk is a platform that enables users to create, publish, share, and sell blog posts and electronic books. The Service includes features for content creation, organization management, team collaboration, and content monetization.

3.1 Eligibility
You must be at least 13 years old to create an account and use the Service. If you are between 13 and 17 years old, you must have your parent or legal guardian's permission to use the Service and they must agree to these Terms on your behalf.
Certain features involving financial transactions (purchases, content sales, paid subscriptions, and payouts) are only available to users who are at least 18 years old or the age of majority in your jurisdiction, whichever is higher.

4. User Content
4.1 Ownership
You retain ownership of all content you create and publish on PinotWalk ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content solely for the purpose of operating and providing the Service.
4.2 Content Responsibilities
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to post the content
- Your content does not infringe any third party's intellectual property rights
- Your content complies with all applicable laws and regulations
4.3 Prohibited Content
You agree not to post content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Infringes any patent, trademark, copyright, or other proprietary rights
- Contains viruses, malware, or other harmful code
- Constitutes spam or unauthorized advertising
- Impersonates any person or entity
- Violates the privacy of others
5. Paid Content and Transactions
5.1 Selling Content
Eligible users may sell content through the Service. By offering content for sale, you agree to provide accurate pricing and descriptions.
5.2 Purchases
When you purchase content, you receive a license to access that content according to the terms specified by the seller. All sales are final unless otherwise required by law.
5.3 Payment Processing
Payments are processed through third-party payment processors (such as Stripe). You agree to comply with their terms of service. We are not responsible for any errors or issues arising from payment processing.
5.4 Fees
We may charge fees for certain features or transactions. Any applicable fees will be disclosed before you complete a transaction.
6. Organizations and Teams
Users may create or join organizations and teams. Organization administrators are responsible for managing membership and content within their organization. Team content is subject to the access controls set by the organization.

The Service, including its design, features, and content created by us, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without our written permission.

9. Termination
9.1 By You
You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
9.2 By Us
We may suspend or terminate your account if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
9.3 Effect of Termination
Upon termination, we may delete your account and User Content. We are not liable for any loss of data resulting from termination.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PINOT WALK, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Pinot Walk, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
